These Terms of Service (“Terms”) govern your use of smart-homeowners.com (the “Site”) and the matching service we provide. By using the Site or submitting a request through our quiz or forms, you agree to these Terms. If you do not agree, please do not use the Site.
This Site is intended for U.S. homeowners aged 18 and older. By using the Site, you confirm you meet these requirements.
1. What We Do
The Smart Homeowner is a free service for homeowners. You complete our quiz with details about your home project, and we match you with a licensed local home service professional in your area who will contact you directly to discuss your project.
We are not a contractor. We do not perform home services ourselves, such as roofing, HVAC, or mold remediation. We do not employ the professionals in our network, supervise their work, or guarantee their pricing, quality, timing, or outcomes.
The professional you are matched with is an independent business. Any agreement, quote, contract, payment, or work performed is strictly between you and that professional.
2. Your Use of the Site
You agree to:
- Provide accurate, current, and complete information when using our quiz or forms.
- Use the Site only for personal, non-commercial purposes related to a genuine home service request.
- Not submit information about anyone other than yourself without their permission.
- Not use the Site to harass, defraud, or mislead us or our professional partners.
You may not scrape, copy, reverse engineer, resell, or redistribute any part of the Site.
3. Communications and SMS Consent
When you submit our quiz or contact form and provide your phone number, you agree that we and our matched professional partner may contact you by phone call, SMS text message (including via automated systems), and email about your project request.
Message frequency varies. Message and data rates may apply. You can opt out of marketing SMS messages at any time by replying STOP. You can opt out of marketing emails by clicking the unsubscribe link in any email. Service-related communications about your specific request may continue after opt-out.
Consent to receive marketing or promotional messages is not a condition of using the Site or receiving a professional match.
4. Professional Matching
We use the information you submit, including your location and project details, to match you with one home service professional we believe is a good fit. We do our best to vet the professionals in our network, but we make no warranties about their performance, licensing status, insurance, work quality, or business practices.
You are responsible for:
- Verifying the professional’s license, insurance, and credentials before hiring.
- Reviewing and signing any contracts directly with the professional.
- Resolving any disputes, complaints, or warranty issues directly with the professional.
We are not a party to any agreement between you and the professional, and we have no liability for the professional’s actions, omissions, or work.
5. Intellectual Property
The Site, including its design, content, logos, text, graphics, and code, is owned by The Smart Homeowner and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our written permission.
When you submit information to us, you grant us a worldwide, royalty-free license to use that information to provide our service, match you with a professional, and improve our platform.
6. Disclaimers
THE SITE AND THE MATCHING SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE QUALITY, ACCURACY, RELIABILITY, OR LICENSING STATUS OF ANY PROFESSIONAL YOU ARE MATCHED WITH.
WE ARE NOT RESPONSIBLE FOR THE WORK, PRICING, CONDUCT, OR ANY OUTCOME OF ANY ENGAGEMENT BETWEEN YOU AND A PROFESSIONAL.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SMART HOMEOWNER, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, PROPERTY DAMAGE, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE SITE OR ANY INTERACTION WITH A MATCHED PROFESSIONAL.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
8. Indemnification
You agree to indemnify and hold harmless The Smart Homeowner and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your interactions with a matched professional.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. For any disputes that are not subject to arbitration under Section 10, you and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware.
10. Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of our service shall be resolved through final and binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Delaware, or remotely by phone or video where permitted.
Class Action Waiver. You and we agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate claims or preside over any form of class proceeding.
Exceptions. Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations.
30-Day Opt-Out. You may opt out of this arbitration agreement and class action waiver by emailing support@smart-homeowners.comwithin 30 days of first using the Site, with the subject line “Arbitration Opt-Out” and including your full name and the email address you used. Opting out will not affect any other part of these Terms.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Sections covering intellectual property, disclaimers, limitation of liability, indemnification, governing law, and arbitration survive termination.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Continued use of the Site after changes are posted means you accept the updated Terms. Material changes will be communicated through the Site.
13. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any right under these Terms is not a waiver of that right. You may not assign these Terms; we may assign them freely.
